Terms of Use
The rules of the night.
The short version: keep your nights, respect other people's, and know how subscriptions work. The full version is below.
Contents
1. Who we are
Nox is a night diary app operated by Raşit Gürses, Turin, Italy ("Nox", "we", "us"). By creating an account or using Nox you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Nox.
2. Your account
- You must be at least 17 years old, and old enough under the law where you live, to use Nox.
- Give accurate information, keep your sign-in details to yourself, and tell us if you think someone else has access to your account.
- One person, one account. You are responsible for what happens on yours.
3. Your content
Your photos, messages and nights stay yours. To run Nox, you give us a limited, non-exclusive, worldwide, royalty-free licence to store, process and display your content, only to provide the app to you and to the people you choose to share it with. This licence ends when you delete the content or your account, except for copies other people already saved, such as a night card you shared.
Only post content you have the right to post. If a photo shows other people, make sure they are fine with it.
4. Crew and sharing
- Nights are private until you share them with a crew. Crew members can see what you share in that crew, live and afterwards.
- You can switch a night to Only me, hide a stop's location, leave a crew, report or block someone at any time.
- Crew owners can remove members. The number of crews you can create and the members per crew depend on your plan; joining a crew you are invited to is never limited by your own plan.
5. House rules
Don't use Nox to:
- harass, threaten, stalk or track anyone, or share someone's location without their consent;
- post content that is illegal, sexual content involving minors, hateful, violent, or that infringes someone else's rights;
- send false "How is it now?" reports, spam, or try to manipulate the map;
- break, overload, scrape or reverse-engineer the app or our servers, or get around limits or paid features.
We may remove content or suspend accounts that break these rules, and we review every report.
6. Nox+ subscriptions
- Plans: Nox+, Nox Pro and Nox Crew, monthly or yearly. What each plan includes and its price in your currency are shown in the app before you buy.
- Billing: payment is charged to your Apple ID when you confirm the purchase. Subscriptions are sold and billed by Apple.
- Auto-renewal: your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged within 24 hours before renewal.
- Free trial: new subscribers may get a 7-day free trial. If you don't cancel at least 24 hours before it ends, the subscription starts and you are charged. A trial is available once per Apple ID.
- Cancel or change: in iPhone Settings → your name → Subscriptions, or from Settings → Nox+ in the app. Cancelling stops the next renewal; you keep access until the end of the period you paid for.
- Refunds: handled by Apple under its policies, at reportaproblem.apple.com. Your statutory rights as a consumer are not affected.
- If a subscription ends: nothing you made is deleted. Crews above the free limit become archived: you can still open them and see past nights, but not add new ones until you choose which crews stay active or subscribe again.
- Price changes: if a price changes, Apple will tell you in advance and, where required, ask for your consent.
7. Crew pass
With Nox Crew, the subscriber can give Nox Pro to up to 4 members of their own crews. Access given this way is personal, cannot be passed on, and ends automatically when the owner's subscription ends, when the owner takes it back, or when the member leaves the crew. The subscriber remains the only person billed.
8. The city tonight
The city tonight shows an estimate of nightlife activity, based on public map data (© OpenStreetMap contributors), opening hours, time, weather and anonymous reports from people out tonight. It can be wrong: places may be closed, full, quiet or not on the map. Use it as a guide, not a guarantee, and always check before you go.
9. Your safety
Nox is a diary, not a safety service. Drink responsibly, follow local laws and venue rules, get home safely, and don't use the app while driving or when you should be watching the road. In an emergency, call your local emergency number (112 in the EU).
10. Apple's terms
Nox is licensed to you under Apple's Standard End User License Agreement, together with these terms. Where they differ, these terms apply to the extent the law allows. Apple is not responsible for Nox or its content and has no obligation to provide support for it.
11. Liability
We work hard to keep Nox running and your nights safe, but the app is provided "as is". To the extent the law allows, we are not liable for indirect losses, lost data you could have backed up, or for what happens on a night out, including decisions made based on The city tonight. Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence, or your rights as a consumer.
12. Ending your use
You can stop using Nox at any time and delete your account under Profile → Delete Account. Deleting your account does not cancel an Apple subscription; cancel it in iPhone Settings first. We may suspend or close accounts that seriously or repeatedly break these terms, and we will tell you why unless the law or safety prevents it.
13. Law and changes
These terms are governed by Italian law. If you are a consumer living in the EU, you also keep the protection of the mandatory laws of your country and can bring a claim there. We may update these terms; for significant changes we will update the date above and, where appropriate, tell you in the app before they apply.
14. Contact
Questions about these terms: hello@nox-io.com. Help with the app: Support. Your data: Privacy Policy.
